Terms of Use
Last updated: [date]
This is a general-purpose template, not legal advice. Fill in the placeholders, and have a
South African attorney review it before relying on it — especially the payment, refund, and
liability sections, since this site handles real money.
By selecting pixels, making a payment, or uploading a photo on
[yoursite.co.za] (the "Site"), you agree to these Terms. If you
don't agree, please don't use the Site.
1. What you're buying
You're purchasing a display slot on a shared digital image — not a physical product, not a share
in any company, and not an investment. A pixel purchase gives you:
- The right to have your uploaded photo displayed on the wall once your payment is confirmed;
- Optional participation in the affiliate program (see §5).
It does not give you ownership of any part of the underlying website, guaranteed
resale value, or any financial return.
2. Pixel placement
The grid position you select and pay for determines your price, size, and shape.
It does not determine the exact final position of your photo. Once you upload a
photo, it is placed automatically wherever it best fits the overall flag pattern based on how
light or dark it is. By uploading a photo, you accept that its displayed position may differ from
the grid location you originally selected.
3. Payment
- Pixels are currently R13.00 per unit (R1.30 per pixel). Prices may change for future purchases at any time; your price is locked in once you've reserved and paid.
- Payment is by EFT/instant payment via the methods shown at checkout. You must use the exact
payment reference provided, or your payment may not be matched to your order.
- Pixels you select are held for a limited time (shown at checkout) while you complete payment.
If payment isn't made in time, they're released back for others to buy.
- Payments are confirmed manually. This can take up to
[24–48 hours]. Your photo will not appear on the wall until
payment is confirmed.
- We reserve the right to decline or reverse any order we reasonably believe to be fraudulent,
unpaid, or in breach of these Terms.
4. Refunds
Because pixel slots are limited and released promptly to other buyers if unpaid, purchases are
generally non-refundable once payment is confirmed, except:
- Where required by South African consumer protection law;
- Where we remove your photo for breaching §6 below, in which case a refund is at our discretion;
- Where we made a clear pricing or system error.
To request a refund, contact us using the details on our About page.
5. Affiliate program
- Every buyer automatically receives a personal invite link and may earn a commission
(currently R2.00 per pixel unit) when someone they refer
completes a confirmed purchase.
- Commission is paid out at our discretion via the contact details you provide, and is not a
guaranteed or ongoing income — we may change or discontinue the program at any time for future
referrals.
- Spamming, misleading people, or otherwise abusing the referral system may result in
forfeiture of unpaid commission.
6. Photo content rules
By uploading a photo, you confirm that:
- You own the photo or have the right to use and publish it;
- It does not depict anyone else without their consent (particularly minors);
- It is not illegal, hateful, sexually explicit, violent, or otherwise offensive;
- It does not infringe anyone's copyright, trademark, or other rights.
We may remove any photo that breaches these rules, at our sole discretion and without notice.
Removal for a content breach does not entitle you to a refund.
7. Your account
You're responsible for keeping your password confidential and for all activity under your
account. Let us know immediately if you believe your account has been compromised.
8. Availability
We aim to keep the Site running reliably but don't guarantee uninterrupted access. We may modify,
suspend, or discontinue any part of the Site at any time.
9. Limitation of liability
To the maximum extent permitted by law, the Site and its operators are not liable for any
indirect, incidental, or consequential loss arising from your use of the Site. Our total
liability to you for any claim is limited to the amount you paid us.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be subject
to the jurisdiction of the South African courts.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted
means you accept the updated Terms.
